Terms of service
Terms of Service – Australia
These Terms of Service apply to use of the Til Kjøkkenet online store by customers shopping for delivery to Australia. The store is operated by Gostol AS, a Norwegian company. Read these Terms together with the product information, the details presented at checkout and our shipping, returns and privacy policies. Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law (ACL) or other applicable law.
1. Seller and contact details
Til Kjøkkenet is operated by Gostol AS, Norwegian organisation number 931 442 341, registered in the Norwegian Register of Business Enterprises.
Business address: Badevikvegen 26, 4160 Finnøy, Norway.
Customer service: kundeservice@tilkjokkenet.no.
Customer service hours: Monday to Friday, 08:00–16:00 Norway time.
Our business address is not automatically the address for returns. Please contact us for the correct return instructions and address.
2. Using the website
You agree to use the website lawfully and not to interfere with its security or operation. You must not upload malicious code, attempt unauthorised access, impersonate another person or misuse the services. You are responsible for providing accurate details when placing an order or contacting us.
We may restrict access to particular website functions where reasonably necessary for security or to address unlawful use, subject to any rights and obligations that apply to existing orders.
3. Product descriptions and availability
We aim to describe products, materials, dimensions, features and available options accurately. Photographs and colours may display differently depending on the screen used. We will not rely on screen differences or website disclaimers to avoid any consumer guarantee that applies to the products supplied.
Product information and availability can change. The description and other information presented when you order are relevant to your purchase, together with any other applicable legal rights. If a product is unavailable after you order, please contact us or respond to our message so that an appropriate outcome can be arranged, including a refund where required.
4. Orders and confirmations
Please check the product, variant, quantity, delivery details and total price before completing an order. If you spot a mistake, contact kundeservice@tilkjokkenet.no promptly with your order number and the email address used at checkout.
Where we discover an obvious pricing or listing error, a technical issue, or a problem fulfilling an order, we will contact you to discuss the available resolution. We will not rely on a general cancellation clause to avoid obligations or remedies that apply under Australian law. We cannot guarantee that an order can be altered or stopped after dispatch.
5. Prices and payment
Product prices, any applicable delivery charges and the order total are presented during shopping and checkout. Review the currency and total shown for your order before confirming payment. Payment methods available to you are those actually displayed at checkout. We do not promise any particular Australian payment option in these Terms.
Payment is processed through the payment services offered at checkout. Please keep your order confirmation or another record of purchase. If a payment or price discrepancy occurs, contact us so we can investigate. Nothing here permits hidden charges or misrepresents the total price payable.
6. Shipping and delivery
Available shipping charges and any delivery estimates for your Australian order are provided in the relevant product information or at checkout, where available. Our separate shipping policy explains tracking, separate parcels, addressing errors and delivery enquiries.
Delivery problems will be assessed under the order agreement and applicable law. A delay or logistics issue does not automatically remove your statutory rights.
7. Australian consumer guarantees
When the Australian Consumer Law applies, products come with automatic consumer guarantees. These include guarantees relating to acceptable quality, matching descriptions and fitness for applicable purposes. The guarantees are not optional warranties and do not depend on whether a product was discounted, bought at an Outlet price or retained in its original packaging.
If a product has a major failure, you may choose a refund or a replacement as provided by the ACL. For a minor failure, we may be entitled to provide a free repair within a reasonable time. If a minor failure is not remedied within a reasonable time, other statutory remedies may become available. Additional compensation may be available where the law provides it.
We, as the seller, will handle consumer guarantee requests; you are not required to seek your statutory remedy directly from a manufacturer or supplier. We may request reasonable proof of purchase. There is no arbitrary 30-day limit on ACL rights.
8. Returns and change of mind
Our separate returns policy sets out our voluntary 30-day change-of-mind offer. Under that voluntary offer, unused products in substantially the same condition may be eligible for return within 30 days of receipt; regular-price items are refunded to the original payment method, while eligible sale items receive store credit as an electronic gift card.
Those voluntary conditions, including the 30-day period, product condition and gift-card treatment, do not apply to or limit remedies required by the ACL for faulty, misdescribed or otherwise non-compliant products. Reasonable return costs for a confirmed product problem are reimbursed as required by law. Contact us for return instructions rather than sending products to the business address.
9. Customer accounts and information
If you choose to create an account, keep your login credentials secure and provide accurate information. Notify us if you suspect unauthorised use. Personal information is handled as described in our privacy policy and according to the laws applicable to the relevant processing.
10. Website content and intellectual property
Website text, photographs, branding, designs and other content may be protected by intellectual property rights. Please do not reproduce, republish, sell or commercially exploit content without permission or another lawful basis. This does not restrict uses permitted by law.
11. Customer submissions and reviews
If you submit a review, comment or other material through a feature designed for customer content, you are responsible for making sure it is accurate to the best of your knowledge and does not infringe another person's rights or contain unlawful or malicious material.
Content submitted for public display may be displayed through the website and related services. We may moderate or remove material where appropriate and lawful, for example when it is abusive, fraudulent, unlawful or infringes third-party rights. We do not require customers to give up consumer rights when posting comments, and nothing here authorises us to fabricate or alter the substance of a customer review.
12. External links and optional tools
The website may include third-party links or tools, including services used to operate the online store. Those services may have their own terms and privacy practices. You should review relevant third-party information before using those services. Our obligations for products we sell, and any rights under the ACL, are not transferred to a third party by these links.
13. Errors and website updates
We may correct typographical errors and update product information, prices and website content. If an error affects an order already placed, we will consider the agreement and applicable legal obligations rather than assuming that a website correction cancels the customer's rights. A general notice that information may be out of date is not a waiver of consumer guarantees or protections against misleading representations.
14. Website availability
We may need to carry out website maintenance or respond to technical outages and security issues. We cannot promise that the website will be available without interruption, but this does not affect an existing customer's rights in relation to an order or exclude liability that cannot lawfully be excluded.
15. Limits of liability
Nothing in these Terms excludes, restricts or modifies consumer guarantees, remedies for major or minor failures, rights concerning misleading conduct or any other liability that cannot lawfully be excluded. We do not sell goods on an “as is” basis that removes these rights, and we do not disclaim acceptable quality, fitness for purpose or compliance with descriptions.
Where the law permits an exclusion or limitation of liability, it applies only to the extent legally permitted and to the particular circumstances concerned. These Terms do not require consumers to indemnify us without limit for ordinary use of the website, nor do they remove rights arising from our own breach of applicable law.
16. Ending website access
You may stop using the website at any time. We may suspend access where reasonably needed for security or a breach of acceptable-use requirements. Ending website access does not automatically cancel an existing order, payment obligation or remedy available under applicable law.
17. Severability and interpretation
If a provision of these Terms cannot lawfully be enforced, it will not be enforced to that extent. The remaining provisions continue to apply to the extent they can lawfully operate, without reducing any mandatory consumer rights.
18. Changes to these Terms
We may update these Terms for future use and publish the current version on the website. Updates do not retrospectively remove rights or change obligations already arising from a completed order without a lawful basis.
19. Applicable law and complaints
Gostol AS is established in Norway. That does not remove the protections of the Australian Consumer Law for eligible purchases supplied directly to consumers in Australia. The laws that mandatorily apply to a transaction continue to apply regardless of our business location. These Terms do not require Australian consumers to pursue a complaint exclusively in Norway.
If there is a problem, please contact us first at kundeservice@tilkjokkenet.no so we can investigate. You may also seek advice from your state or territory consumer protection agency or obtain independent legal advice. The Australian Competition and Consumer Commission (ACCC) provides guidance and accepts reports, but does not decide individual consumer disputes.
